Memphis and Shelby County Air Board Meetings

    PUBLIC NOTICE


The Memphis & Shelby County Air Pollution Control Board (Board) will hold a meeting at the Renaissance Center, 555 Beale Street, Memphis, TN on  Wednesday,  December 5th, 2018 at 1:30pm.

Agenda items will include: 

               Air Pollution Control Section Budget, Emissions and Permit Fees, which are charged to Shelby County industries. 

              Other matters the Shelby County Health Department’s Pollution Control Section and Board deem necessary for the operation                   of  the Air Pollution Control Program under the local air pollution codes and the Board’s by-laws.

The meeting is open to the public.

NOTICE OF PUBLIC HEARING

AND DOCUMENT PLACEMENT


Notice of Public Hearing on proposed ordinances to amend the Air Pollution Codes of Shelby County, of the City of Memphis, and of the municipalities of Arlington, Bartlett, Collierville, Germantown, Lakeland, and Millington to incorporate by reference certain Rules and Regulations of Tennessee regarding air pollution control is hereby given.  The public hearing will be held in the Benjamin L. Hooks Central Library 3030 Poplar Ave., Memphis, Tennessee and is scheduled for 6:00 to 7:30 PM p.m. December 5th, 2018 to receive comments.

The Tennessee Air Quality Act allows local government to be exempt from its provisions provided they adopt regulations not less stringent than the standards adopted for the State of Tennessee pursuant to the Tennessee Air Quality Act.  Every even numbered year the Shelby County Health Department must demonstrate to the Tennessee Air Pollution Control Board that Shelby County, the City of Memphis, and the included municipalities have enacted provisions not less stringent than the standards adopted for the State of Tennessee for air pollution control in order to be granted a certificate of exemption in accordance with T.C.A.  §68-201-115.

Incorporation by reference of the following Rules and Regulations of the Tennessee Division of Air Pollution Control effective on  December 5th, 2018, by Shelby County, the City of Memphis, and the municipalities of Arlington, Bartlett, Collierville, Germantown, Lakeland, and Millington will allow the local air pollution control program to maintain its exempt status.  They are; Chapters 1200-3- 2 Definitions; 1200-3-3 Ambient Air Quality Regulations, 1200-3-5 Visible Emissions, 1200-3-6 Non-process Emission Standards, 1200-3-7 Process Emission Standards, 1200-3-9 Construction and Operating Permits; 1200-3-10  Required Sampling, Recording and Reporting: 1200-3-11 Hazardous Air Contaminants, 1200-3-12 Methods of Sampling and Analysis; 1200-3-14 Control of Sulphur Dioxide Emissions; 1200-3-15 Emergency Episode Plan; 1200-03-16 New Source Performance Standards; 1200-3-18 Volatile Organic Compounds; 1200-3-20 Limits on Emissions due to Malfunctions, Startups and Shutdowns; 1200-3-21 General Alternate Emission Standards; 1200-3-22 Lead Emission Standards; 1200-3-24 Good Engineering Practices Stack Height Regulations;  1200-3-25 Standards for Infectious Waste Incinerators; 1200-3-30; Acid Precipitation Standard; 1200-3-31 National Emission Standards for Hazardous Air Pollutants for Source Categories; 1200-3-32 Prevention of Accidental Releases; and 1200-3-34 Conformity ; T.C.A.  §68-201-101 through -118.

In accordance with T.C.A. §68-201-115, at least three (3) copies of the Rules and Regulations of Tennessee  proposed for incorporation by reference have been filed in the Office of the Clerk of the Shelby County Commission, 160 North Main, Suite 600, Memphis, Tennessee for a period of at least thirty (30) days prior to adoption for public use, inspection and examination. Additionally in accordance with T.C.A. 6-54-502 one copy of the Rules and Regulations of Tennessee  proposed for incorporation by reference have been filed in the Records Management Office for the City of Memphis.
